Terms of Use and End User License Agreement

These Terms of Use and End User License Agreement ("Terms") are a binding agreement between you and Ron Tabachnik ("we", "us"), the operator of the Shalom mobile application ("App"). By downloading, installing or using the App you accept these Terms, our Privacy Policy, Community Guidelines, Disclaimers and Claim Policy, which form part of these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 16 years old to create an account. By creating an account you confirm that you meet this requirement and that the information you provide is accurate. Features that let you meet other people (minyanim, events, meals and messages) are intended for adults; users under 18 must use them only with the knowledge of a parent or guardian.

2. What the App is

The App is an informational and community platform. It lists Jewish community places such as kosher food businesses, synagogues, Chabad houses, mikvaot, community centers and historic sites, shows calendar and prayer times from third-party sources, and lets users post, comment, message each other, organize minyanim and events, and review places.

We do not own, operate, inspect, certify or endorse any place, business, event, host or user listed in the App. We are not a kashrut authority, a halachic authority, a travel agent, an event organizer or a party to any arrangement between users.

3. License

We grant you a personal, revocable, non-exclusive, non-transferable, non-sublicensable license to use the App on Apple devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, modify, reverse engineer, decompile, scrape, resell, rent or create derivative works from the App or its data, except as allowed by law.

4. Your account

You are responsible for your account, your password and all activity under your account. Tell us immediately at ron@digitab.co.il if you suspect unauthorized use. You can delete your account at any time from the Profile screen.

5. Your content

"User Content" means anything you submit: places, posts, comments, reviews, photos, messages, minyanim, events, profile details and claim documents.

6. Zero tolerance for objectionable content

The App has zero tolerance for objectionable content and abusive users. You must follow the Community Guidelines. You can report content and block users from within the App. We review reports and act on objectionable content, normally within 24 hours, by removing the content and, where appropriate, removing the user who posted it.

7. Meeting people and attending places

Minyanim, events, Shabbat and holiday meals, and direct messages may lead to in-person meetings. You attend any meeting, place or event at your own risk and are solely responsible for your safety and conduct. Follow the safety advice in the Disclaimers. We do not run background checks, verify identities (other than the limited review of place claims) or supervise any meeting.

8. Places, claims and verification

Place information comes from public sources, users and verified managers and may be wrong or out of date. Business owners and managers can claim a place under the Claim Policy. A "Verified" badge only means we reviewed documents presented to us at a point in time; it is not a guarantee, endorsement or kashrut certification.

9. Third-party services and links

The App uses third-party services such as Apple Maps, Supabase, Cloudflare and HebCal, and may link to third-party websites and phone numbers. We are not responsible for third-party services, websites, content or practices. Your use of them is governed by their terms.

10. Notifications

Reminders for candle lighting, Havdalah, Tefillin, events and minyanim are a convenience only. They may be late, missing or inaccurate because of device settings, connectivity, time zones or data errors. Do not rely on them for halachic decisions.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, KASHRUT STATUS, HALACHIC CORRECTNESS AND NON-INFRINGEMENT.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF THE APP, ANY PLACE, EVENT OR MEETING, OR ANY CONDUCT OF OTHER USERS OR THIRD PARTIES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR 100 ISRAELI NEW SHEKELS. Some jurisdictions do not allow certain limitations; in that case they apply to the fullest extent allowed.

13. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, damages and expenses (including reasonable legal fees) arising from your User Content, your use of the App, your meetings with other users, or your breach of these Terms or any law.

14. Intellectual property and takedown

The App's design, code, name and logo belong to us or our licensors. If you believe content in the App infringes your rights, email ron@digitab.co.il with the content's location, a description of your rights, and your contact details. We will review and act on valid notices.

15. Apple terms

These Terms are between you and us, not Apple Inc. ("Apple"). Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims; we are responsible for those to the extent required by these Terms. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Changes and termination

We may change the App or these Terms at any time. We will show material changes in the App. Continuing to use the App after a change means you accept it. We may suspend or end your access at any time. Sections 5, 7, 11, 12, 13, 17 and 18 survive termination.

17. Governing law

These Terms are governed by the laws of the State of Israel, without regard to conflict of law rules. Disputes will be heard exclusively by the competent courts of Tel Aviv-Jaffa, Israel, unless mandatory consumer law in your country of residence gives you the right to sue locally.

18. General

If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not transfer these Terms; we may transfer them in connection with a merger, acquisition or sale of assets. These Terms are the entire agreement between you and us about the App.
